1. Introduction and Acceptance of Terms
Welcome to Studio One Dance Academy ("the Academy", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Academy's website and all associated services, including class enrolments, workshops, events, and any other offerings provided by the Academy.
By accessing our website, completing an enrolment form, or otherwise engaging with our services, you ("you", "the student", "the parent", "the guardian", or "the visitor") confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.
These Terms are governed by the laws of the Republic of South Africa, including but not limited to the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), and the Protection of Personal Information Act 4 of 2013 ("POPIA").
2. Definitions
In these Terms, unless the context otherwise requires:

"Academy" means Studio One Dance Academy, a business operating in Cape Town, Western Cape, South Africa.

"Website" means the Academy's website and all associated digital platforms.

"Services" means all classes, workshops, performances, events, and related offerings provided by the Academy.

"Student" means any individual enrolled in or attending Academy programmes.

"Parent/Guardian" means the parent or legal guardian of a minor student.

"Minor" means any person under the age of 18 years.

"User" means any person accessing the Website, whether or not enrolled with the Academy.

"Fees" means all tuition, registration, costume, examination, and other charges payable to the Academy.
3. Use of the Website
3.1 Eligibility
Use of this Website is available to all users. Enrolment in Academy programmes is subject to the conditions set out in Section 4. Minors may only enrol with the express written consent of a parent or legal guardian, who accepts these Terms on the minor's behalf.
3.2 Permitted Use
You may access and use the Website solely for lawful purposes and in accordance with these Terms. You agree not to:

Use the Website in any way that violates applicable South African or international law or regulation

Reproduce, duplicate, copy, sell, or exploit any part of the Website without our express written permission

Transmit or distribute any harmful, offensive, defamatory, or unlawful content through the Website

Attempt to gain unauthorised access to any part of the Website or its related systems

Use automated tools, bots, or scrapers to extract content from the Website
3.3 Accuracy of Information
While we endeavour to keep information on our Website accurate and up to date, we do not warrant the completeness or accuracy of any content. Class schedules, fees, and offerings are subject to change without prior notice.
4. Enrolment and Registration
4.1 Registration Process
Enrolment in Academy classes requires completion of the Academy's official registration form, payment of any applicable registration fee, and acceptance of these Terms. Enrolment is confirmed only once the Academy has acknowledged receipt of your completed registration and applicable fees.
4.2 Age and Class Placement
Students are placed in classes appropriate to their age, experience, and ability at the Academy's sole discretion. The Academy reserves the right to reassign a student to a different class if deemed more appropriate for their level or wellbeing.
4.3 Health and Medical Disclosure
You are required to disclose, at the time of registration and on an ongoing basis, any medical conditions, injuries, allergies, or physical limitations that may affect a student's participation in dance activities. The Academy accepts no liability for injury or harm arising from failure to disclose relevant medical information.
4.4 Code of Conduct
All students, parents, and guardians are expected to treat Academy staff, fellow students, and visitors with courtesy and respect. The Academy reserves the right to terminate the enrolment of any student whose conduct is deemed disruptive, harmful, or contrary to the Academy's values, without refund of fees paid.
5. Fees and Payment
5.1 Fee Structure
All applicable fees, including monthly tuition, registration fees, examination fees, costume fees, and any other charges, will be communicated at the time of enrolment or in advance of any event. The Academy reserves the right to revise its fee structure at any time, with reasonable prior notice to enrolled students.
5.2 Payment Terms

Monthly tuition fees are due and payable on or before the 1st day of each calendar month

Fees not paid within [insert grace period, e.g. 7 days] of the due date may attract a late payment penalty

Fees are payable via the payment methods listed on the Academy's website or invoice, which may include EFT, debit order, or other approved methods

Cash payments must be accompanied by an official receipt issued by the Academy
5.3 Non-Refundable Fees
Registration fees and examination entry fees are non-refundable once paid. Monthly tuition fees are non-refundable except where the Academy cancels a class or programme. Refunds, where applicable, are subject to the Academy's refund policy in force at the relevant time.
5.4 Suspension for Non-Payment
The Academy reserves the right to suspend a student's participation where fees remain outstanding for more than [insert period, e.g. 30 days]. Continued non-payment may result in cancellation of enrolment. Outstanding fees remain due and payable notwithstanding any suspension or cancellation.
6. Cancellation and Withdrawal
6.1 Withdrawal by Student
Should you wish to withdraw a student from the Academy, written notice of at least [insert notice period, e.g. one calendar month] must be provided to the Academy. Fees for the notice period remain payable in full. Failure to provide adequate notice may result in a notice-period fee being charged.
6.2 Cancellation of Classes by the Academy
The Academy may cancel individual classes due to public holidays, instructor illness, adverse weather, or other unforeseen circumstances. Where possible, make-up classes will be arranged. No refund will be issued for individual cancelled classes where a make-up class is offered.
6.3 Suspension or Termination by the Academy
The Academy reserves the right to suspend or terminate a student's enrolment without refund in the following circumstances:

Persistent non-payment of fees

Serious, persistent, or dangerous misconduct by the student or their parent/guardian

Misrepresentation of medical or other material information at the time of registration

Any other circumstances deemed by the Academy to be contrary to the welfare of students or staff
7. Health, Safety, and Limitation of Liability
7.1 Inherent Risks
Dance and physical activity carry inherent risks of injury. By enrolling a student in Academy programmes, you acknowledge and accept these risks. The Academy takes reasonable steps to maintain a safe environment but cannot guarantee that injuries will not occur.
7.2 Limitation of Liability
To the fullest extent permitted by South African law, including the Consumer Protection Act, the Academy, its directors, employees, and instructors shall not be held liable for any injury, loss, or damage suffered by a student arising from participation in Academy activities, except where such injury, loss, or damage is caused by the gross negligence or wilful misconduct of the Academy or its staff.
Note: The Consumer Protection Act 68 of 2008 limits the extent to which liability for injury or death may be excluded by contract. Please obtain legal advice regarding the enforceability of liability limitations applicable to your circumstances.
7.3 Emergency Medical Treatment
In the event of an emergency involving a minor student, Academy staff may authorise emergency medical treatment if a parent or guardian cannot be contacted in time. Any costs associated with such treatment are the responsibility of the parent or guardian.
7.4 Personal Property
The Academy accepts no responsibility for loss, theft, or damage to students' personal property, clothing, or equipment on Academy premises or at Academy events.
8. Photography, Videography, and Media Consent
The Academy may photograph or video record students during classes, performances, and events for the purposes of:

Promotional and marketing materials (website, social media, print)

Progress monitoring and educational feedback

Competition and examination submissions
Such recordings will only be used with the prior written consent of the student (or parent/guardian where the student is a minor). Consent may be withdrawn at any time in writing. Parents and guardians are reminded that photographing or recording other students without consent is strictly prohibited on Academy premises.
9. Intellectual Property
All content on the Academy's website, including but not limited to text, graphics, logos, choreography descriptions, training materials, and images, is the intellectual property of the Academy or its licensors and is protected by South African copyright law.
You may not reproduce, republish, distribute, transmit, or commercially exploit any content from the Website without the prior written consent of the Academy. Choreographic works created by Academy instructors remain the intellectual property of the Academy and may not be reproduced or performed outside of Academy events without express written permission.
10. Privacy and Data Protection
The Academy is committed to protecting your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). The collection, use, and protection of personal information is governed by the Academy's Privacy Policy, which forms part of these Terms and is available on the Website.
By accepting these Terms, you also acknowledge and agree to the Academy's Privacy Policy. You may request a copy of the Privacy Policy at any time by contacting the Academy.
11. Electronic Communications
By providing your contact details, you consent to receiving electronic communications from the Academy, including class schedules, newsletters, fee notices, and event updates. In accordance with ECTA and the CPA, you may opt out of marketing communications at any time by following the unsubscribe instructions in each communication or by contacting the Academy directly.
12. Changes to These Terms
The Academy reserves the right to amend these Terms at any time. Updated Terms will be posted on the Website with a revised effective date. Where changes are material, the Academy will provide reasonable prior notice to enrolled students. Your continued use of the Website or Academy services following any change constitutes acceptance of the revised Terms.
13. Dispute Resolution
In the event of a dispute arising from these Terms or the Academy's services, the parties agree to first attempt to resolve the matter through good-faith negotiation. Should negotiation fail, the parties may refer the matter to mediation before pursuing any formal legal proceedings.
These Terms are governed by the laws of the Republic of South Africa. Any legal proceedings shall be instituted in the appropriate courts of South Africa, and both parties submit to the non-exclusive jurisdiction of such courts.
Note: The Consumer Protection Act provides consumers with rights that cannot be limited by contract. Nothing in these Terms is intended to limit any right afforded to you under South African consumer legislation.
14. Severability and Entire Agreement
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from the remaining Terms, which shall continue in full force and effect. These Terms, together with the Academy's Privacy Policy and any enrolment agreements, constitute the entire agreement between you and the Academy with respect to the subject matter herein.
